Terms of Service

These Terms of Service ("Terms") govern your access to and use of MoraViral at moraviral.com (the "Service"), operated by MoraViral ("we", "us", "our"). MoraViral is an online tool that uses artificial intelligence to generate videos and images from text prompts and uploaded images. By creating an account, subscribing, or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

• You must be at least 18 years old, or the age of legal majority where you live, to use the Service.
• You must give accurate information when you register and keep it up to date.
• You are responsible for keeping your password secure and for all activity that happens under your account. Tell us immediately at info@moraviral.com if you suspect unauthorized use.
• One person may not run multiple accounts to abuse free credits, referral rewards or coupons.

2. Subscriptions and billing

• Paid plans are billed in advance through PayPal, monthly or yearly, and renew automatically at the then-current price until you cancel.
• You can cancel at any time from the Billing page. Cancellation stops future renewals; it does not refund the current period except as described in our Refund Policy.
• Coupons and introductory discounts apply only to the billing periods stated when you subscribe.
• Prices are shown in US dollars and may exclude taxes that your payment provider or country applies.
• We may change plan prices or included credits. Changes apply from your next billing period, and we will tell you in advance by email or in the app.
• If a payment fails, is reversed or is charged back, we may pause your account and remove credits granted by that payment.

3. Credits

• Each plan gives you its credits for a 30-day cycle. At the start of every new cycle (your monthly renewal, or every 30 days on yearly plans) unused plan credits are reset to the plan's amount; they do not roll over. You can also buy one-time credit boosts while subscribed.
• Every generation shows its credit cost before you start it, and that amount is deducted when the job begins.
• If a generation fails or times out, its credits are returned automatically.
• Credits have no cash value, cannot be transferred, sold or exchanged, and are not refundable except as stated in our Refund Policy.
• Boost and referral credits do not reset. If your subscription ends, unused plan credits expire 30 days after your last cycle started. All credits are forfeited if your account is deleted or terminated for breaking these Terms.
• We may adjust the credit cost of models when our provider costs change. Any change is shown before you generate.

4. Acceptable use

You agree not to use the Service to create, upload or share content that:

• is illegal, or promotes illegal activity;
• is sexually explicit, or sexualizes or depicts minors in any way;
• harasses, threatens, bullies, defames or invades the privacy of anyone;
• depicts a real, identifiable person without their consent, or impersonates anyone;
• is designed to deceive, such as fake news, election misinformation or fraudulent deepfakes;
• promotes violence, terrorism, self-harm, hate or discrimination;
• infringes anyone's copyright, trademark or other rights, including uploading images you do not have the right to use.

You also agree not to resell or share account access, scrape or overload the Service, try to bypass credit limits, safety filters or security measures, or reverse-engineer the Service. We use automated safety checks and may refuse any prompt or upload.

5. Your content and ownership

• You keep any rights you have in the prompts and images you upload ("Inputs").
• Subject to these Terms and to the terms of the AI model providers we use, you own the videos and images you generate ("Outputs") and may use them for personal and commercial purposes, including ads and client work.
• You give us a limited, worldwide license to store, process and display your Inputs and Outputs only as needed to run the Service for you.
• Creations are private by default. If you make a creation public or share its link, you allow us to display it, including in our public showcase. You can make it private again at any time.
• AI models can produce similar Outputs for different users. We cannot guarantee that your Outputs are unique or that they can be protected by copyright where you live.

6. AI limitations

AI-generated content can be inaccurate, unexpected or imperfect. You are responsible for reviewing Outputs before you publish them, and for following the rules of the platforms where you post them, including any requirement to label content as AI-generated.

7. Third-party services

The Service relies on third parties, including PayPal for payments, fal.ai for AI model processing, Supabase for accounts and storage, and Hostinger for hosting. Their own terms and policies also apply to your use of their services, and we are not responsible for their outages.

8. Availability and changes

We work to keep the Service available, but we do not guarantee it will be uninterrupted or error-free. We may add, change or remove models and features at any time. If we make a material change to these Terms we will notify you, and continued use after the change means you accept it.

9. Suspension and termination

You can cancel your subscription from Billing and delete your account from Settings at any time. We may suspend or terminate your account, without refund, if you break these Terms, create risk or legal exposure for us, or abuse payments, coupons or referrals.

10. Disclaimers

The Service and all Outputs are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent allowed by law.

11. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to defend and indemnify us against claims, damages and costs arising from your Inputs, your use of Outputs, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the country where MoraViral's operator is established, without regard to conflict-of-law rules. If you are a consumer, you also keep any protections given to you by the mandatory laws of the country where you live.
